		<description>if a person is asleep behind the wheel in the middle of the roadway with the engine still running, but refuses a breath or blood test, is there much chance of winning a case for lack of sufficient evidence. In other words, a jury cannot convict based on what they assume or what it looks like, unless it is beyond a reasonable doubt. Why would an attorney believe the accused only has a 15% chance of winning in a jury trail?</description>
